Melissa for Educators AI Platform

Effective Date: August 6, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the Melissa platform (melissaforeducators.ai), including all related services, features, and content (collectively, the “Service” or “Melissa”). The Service is operated by Melissa for Educators (“we,” “us,” or “our”). By creating an account, signing up, or using the Service, you agree to these Terms. If you are entering these Terms on behalf of a school, district, or other entity, you represent that you have authority to bind that entity.

1. Eligibility and Accounts

  • You must be at least 18 years old and a teacher, administrator, or authorized representative of a K-12 school or district.
  • Teacher/administrator accounts use email + password (Supabase Auth). You are responsible for maintaining account security and all activity under your account.
  • Student accounts are created and managed under your classes:
    • Grades 6–12: You provide names only; students self-register via class code (no email required).
    • Grades K–5: You create accounts with picture passwords.
  • You warrant that you have all necessary rights, consents, and authorizations (including under COPPA and FERPA) to provide student data and allow students to use the Service for educational purposes.

2. Use of the Service

  • The Service is provided solely for K-12 educational purposes (lesson planning, assignment creation, student interaction, grading, and TIA-style documentation).
  • “Prepare a Class” and assignment features trigger an automated cascade (generation → delivery to students → completion → grading → documentation). You are responsible for reviewing all AI-generated content before use.
  • AI Zones (Prohibited / Assisted / Required) must be respected. Students may not circumvent them.
  • You grant us a limited license to host, process, and display content you or your students upload or generate.
  • We do not use student personal information to train AI models or for any purpose other than providing the Service.

3. Student Data and Compliance

  • You (or your school/district) own all student data. We act solely as a service provider and “school official” with legitimate educational interest under FERPA and under the school-consent exception to COPPA.
  • You are solely responsible for:
    • Obtaining any required parental consents or providing school-authorized notice.
    • Ensuring student data is used only for educational purposes.
    • Complying with all applicable laws (FERPA, COPPA, state student privacy laws, etc.).
  • We will not sell, rent, or use student data for marketing or advertising.

4. Payments and Subscriptions

  • Melissa Free: free forever, no credit card required. Melissa Pro: billed annually. District plans: custom pricing.
  • Payments processed via Stripe. Subscriptions auto-renew unless canceled.
  • We may change prices with notice. Refunds are at our discretion except where required by law.

5. Intellectual Property

  • The Service, AI models, prompts, and all original content are our exclusive property.
  • You retain ownership of your lesson plans, assignments, and student work. We may use anonymized, aggregated data to improve the Service (never student-identifiable data).

6. Prohibited Conduct

You may not: reverse-engineer the Service, circumvent AI zones, share login credentials, upload harmful code, or use the Service for any non-educational or illegal purpose.

7. AI Output Disclaimer

AI-generated content is probabilistic and may contain errors. You must review all output for accuracy, appropriateness, and alignment with standards before use with students. We are not liable for any reliance on or consequences of AI output.

8. AI Image Generation

Use of AI Services

Certain features of the Service use artificial intelligence provided by third-party providers, including OpenAI, to generate presentation images based on user prompts and instructions.

Generated Content

Images generated through the Service are created by artificial intelligence in response to user inputs. The Company does not guarantee that any generated image will be accurate, unique, complete, or suitable for a particular purpose.

User Responsibility

Users are responsible for reviewing all AI-generated images before using, publishing, or distributing them. Users are solely responsible for determining whether generated images are appropriate for their intended use and comply with applicable laws, regulations, contractual obligations, and organizational policies.

Platform Guardrails

The Service applies automated safeguards to generated images. Unless expressly enabled by the Company, generated presentation images:

  • do not contain readable text;
  • do not depict real or identifiable persons;
  • exclude human figures by default; and
  • may be modified or declined if a request conflicts with the Service's safety requirements.

Prohibited Requests

Users may not use the AI image generation features to attempt to:

  • generate or recreate identifiable individuals;
  • create misleading or deceptive content;
  • infringe the intellectual property or other rights of third parties;
  • circumvent the Service's safety measures or content restrictions; or
  • generate content that is unlawful or otherwise prohibited under these Terms.

Similarity of Outputs

Because artificial intelligence systems generate content algorithmically, similar or identical images may be generated for other users. The Company does not guarantee the exclusivity or uniqueness of any generated image.

AI Service Availability

AI image generation depends on third-party services. The Company may modify, suspend, replace, or discontinue AI models, generation capabilities, styles, or output characteristics without prior notice.

No Professional or Factual Representation

AI-generated images are intended as illustrative presentation assets and should not be relied upon as factual evidence, technical documentation, legal exhibits, or representations of real-world events without independent verification.

9. Termination

We may suspend or terminate access for violation of these Terms, non-payment, or to protect the Service. Upon termination, student data remains available to you for export for 30 days (then securely deleted unless legally required to retain).

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or student outcomes. Our total liability will not exceed the amount you paid in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from (a) your or your students' use of the Service, (b) any student data you provide, or (c) your failure to obtain required consents.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Disputes will be resolved in the courts of Travis County, Texas.

13. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.
